A new statutory Order has extended to teachers the right to participate in salary sacrifice arrangements. Until now, the School Teachers' Pay and Conditions Document did not permit teachers to give up their entitlement to pay and the change comes as the result of growing pressure from teachers, their employers and representatives, to allow participation in salary sacrifice.

The Order allows teachers to participate in any salary sacrifice arrangement operated by their employer and for gross pay to be reduced accordingly for the period of participation. However, the Order specifically provides for teachers' pre-salary sacrifice salary to be "safeguarded" for other employment provisions.

The salary sacrifice schemes in which teachers may participate are limited to

• child care voucher and other child care benefit schemes
• cycle and cyclist's safety equipment schemes
• mobile telephone schemes.
