There are two Codes of Practice aimed at employers on the website of the Border and Immigration Agency, one covering civil penalties for employers, the other on avoiding unlawful discrimination. The draft versions of these Codes, which were published when the changes to employer procedures from 29 February 2008 were announced, have been replaced by final versions. The changes are cosmetic; there are no differences in the guidance provided.

The maximum penalty that can be imposed for engaging an illegal worker is £10,000. The Order introducing this penalty was made on 22 January and comes into force on 29 February. The civil penalties Code of Practice explains how the penalty will be calculated in practice; the maximum penalty, which applies for each illegal worker engaged, will only apply where an employer conducts no document checks and is repeatedly found to be employing illegal migrant workers.
