DOL recovers over $44,000 for restaurant workers

Key West, FL
- The owner of a restaurant has agreed to pay $44,443 in overtime back wages to 25 employees after the U.S. Department of Labor's Wage and Hour Division determined the company violated the Fair Labor Standards Act (FLSA).

A Wage and Hour investigation determined that the company paid servers, dishwashers and food preparers a straight salary, regardless of the number of hours they worked. Because the restaurant failed to keep accurate records, investigators interviewed the employer and employees to determine hours of work.

Employer owes more than $831,000 in overtime back wages and damages

Hicksville, NY
- The U.S. Supreme Court has let stand a U.S. Court of Appeals ruling that a wholesale distribution of candy, cigarettes and tobacco, and its president, must pay more than $831,000 in back wages and liquidated damages, plus interest, to more than 100 employees. The back wage liability resulted from the company's failure to pay overtime compensation as required by the FLSA.

An investigation by the Labor Department's Wage and Hour Division found that the company did not keep proper records or pay overtime compensation as required by the FLSA. The Court of Appeals for the Second Circuit in New York previously had remanded the case to the district court for a re-computation of the back wages. After a second trial, the district court accepted the department's calculation of back wages and liquidated damages totaling more than $831,000. The Court of Appeals affirmed the ruling. The employer's appeal of that decision was denied on October 11 by the U.S. Supreme Court.

$87,850 in back wages for 40 truck center employees

West Valley City, UT
- The U.S. Department of Labor has announced today that a truck center has paid $87,241 in back minimum wages to 38 employees for violations of the FLSA minimum wage requirements. The company also paid $609 in overtime back wages to one employee.

The employer violated the FLSA by failing to pay salespersons the required minimum wage during weeks in which no sales were made. The employer also violated the overtime provisions of the Act by failing to pay an hourly employee time and one-half after 40 hours of work in a workweek.

Fast-food chain owes employees $186,000

Los Angeles, Glendale, Panorama City and Union City, CA
- The Department of Labor has recovered $186,152 for 82 cooks, servers and cashiers who worked at a fast-food chain in California. The owners paid nonexempt employees a straight-time rate for all hours worked, a violation of the federal Fair Labor Standards Act (FLSA).

An investigation by the department's Wage and Hour Division determined that employees worked up to 50 hours per workweek and earned only a fixed salary without an overtime premium. The investigation also found that none of the locations kept accurate payroll records and the firm paid many employees in cash.
