Thirty-four states, the District of Columbia and the U.S. Virgin Islands have minimum wage provisions that set rates equal to or higher than the Federal rate. Four individual city governments and three federally-recognised Indian tribes also set minimum rates that exceed the relevant federal or state minimum rate.

The minimum hourly rate shown below for each of these states is the highest applicable rate. Note, however, that workers in some occupations and industries have a different rate or are exempt from the minimum rate(s) for the state. If no higher state minimum rate applies, the Federal minimum rate applies.
