Advice for California employers
The third quarter 2004 issue of California Employer provides guidance for employers on how to protect employees from unemployment protection fraud. Among the many suggestions are:
- check every EDD form received and report any discrepancies immediately
- properly dispose of old payroll records, in accord with California law that requires personal information in all records under the employer's control to be properly destroyed i.e., shred, erase, etc.)
- verify the Social Security numbers of new employees with the Social Security Administration to ensure that wages are reported properly
- keep detailed records of former employees in order to respond to EDD enquiries
- instead of Social Security numbers, use an alternate number to identify employees
- contact EDD right away if it appears that personnel records or other personal information has been compromised or stolen, or if fraud on the employer account is suspected.
The newsletter also includes advice on how to help employees who incur bank charges because they do not have a bank account.

Tax relief for victims of wildfire disaster areas
The Employment Development Department has announced an extension on filing employment tax returns and payments for Shasta county employers in disaster areas consumed by wildfires. Employers directly affected by the recent fires who need additional time to file their payroll tax returns and pay their employment taxes may be eligible for an extension until October 21, 2004, without penalties or interest charges.

California - Paid Family Leave insurance program
From July 1, 2004, some 13 million California workers are covered for Paid Family Leave insurance benefits. The disability compensation provisions are extended to individuals who take time off of work to care for a seriously ill child, spouse, parent, or domestic partner, or to bond with a new child. The program provides up to six weeks of benefits during a one-year period and is fully funded by payroll deductions. Since January 1, 2004, employers have been required to deduct the Paid Family Leave contributions from the wages of employees who are covered by the SDI program.

California
The Senate has passed the Paycheck Cashing Charges Bill on May 19 by 28 votes to nil after its 3rd reading. The Bill now goes to the Assembly for consideration. This bill would prohibit a bank from assessing a charge or fee to cash a paycheck for a person who does not have an account at the bank if the paycheck was issued by the bank for a business client of the bank that provides the paychecks to its employees.
