Relief for tropical storm Ivan victims
Businesses and individuals in 26 Georgia counties and areas in surrounding states struck by Tropical Storm Ivan and declared a Presidential Disaster Area are eligible for a 30-day filing extension and assistance from the Georgia Department of Revenue.

Georgia counties in the disaster area are Banks, Carroll, Cherokee, Cobb, Dade, Dawson, DeKalb, Early, Elbert, Fannin, Forsyth, Franklin, Fulton, Gilmer, Habersham, Harris, Heard, Lumpkin, Madison, Miller, Pickens, Rabun, Towns, Union, White, and Wilkes. The disaster area also includes counties in Alabama, Florida, Louisiana, Mississippi, North Carolina and Pennsylvania.

Revenue Department Increases Levying Activities
The Department of Revenue has increased its levying action activities throughout the state by forming a five-member special levying team. Since January 2004, the Department has collected over $1.9 million in unpaid sales and use tax, withholding tax, and corporate and individual income tax through business closures, bank levies and confiscating unpaid taxes from business cash registers.

The agents have also closed 33 businesses during that same time period. Several of the closed businesses reopened after settling their tax obligation or entering into bankruptcy. Most closures are a result of the taxpayer's failure to remit sales or withholding tax, which was collected from customers and employees and to which the business owner has no entitlement.

Tax relief for hurricane victims
The Department of Revenue has announced that businesses and individuals in the 36 Florida counties affected by Hurricane Frances will be given a 30-day filing extension by writing 'Tropical Storm September 2004' across the top of their returns. The Department has previously given a similar extension to taxpayers in the 25 Florida counties declared a Presidential Disaster Area following Tropical Storm Bonnie and Hurricane Charley.

The June 2004 issue of Georgia Revenue Quarterly provides details of the tax laws passed during the 2004 Georgia Legislative Session. Among the changes is a new penalty equal to 10% of the tax due for failure remit withholding tax where payment was required to be made in immediately available funds such as via electronic transfer and was not. The new provision is effective when signed by the Governor or July 1, 2004, whichever occurs first.
