Recently passed labor laws become effective January 2006

The following new labor laws take effective from January 1, 2006:
- the civil penalty that the Labor Commissioner may impose increases from $1,000 to $2,500
- the Commissioner is empowered to hold hearings and investigate charges of violations of the labor protection statutes either on his or her own motion or on an employee complaint
- the Department of Labor is added as a party entitled to initiate a wage claim and the period in which to file a wage claim is extended from 18 months to 36 months
- voluntary deductions may be made from wages for loans, accidental overpayments, tuition, and certain time off (a sample authorization form is available)
- the new Crime Victim Employment Leave Act requires employers to allow employees who are victim of certain crimes to leave work to attend court or other legal or investigative proceedings associated with the prosecution of the crime.
The following changes to labor laws took effect earlier in 2005:
- from October 22, 2005, deductions in wages are allowed when requested by the employee for contributions to political action committee
- from January 1, 2005, an employer is allowed to prorate the salary of an employee who is terminated for cause, and an employer is allowed to withhold certain items from an employee's wages when the employee requests the withholding in writing.
