Employers fined for wage offences - Hong Kong Payroll News

Two employers have been fined in the past week in the Eastern Magistrates' Courts wage offences under the Employment Ordinance. The prosecutions were launched by the Labour Department. In both cases, the employers failed to pay wages to employees within seven days of the expiry of the wage period as required by the ordinance. The amount of wages involved was about HK$179,000 (US$23,000) in one case and HK$10,500 in the other. Both employers had paid the outstanding wages to the employees concerned before the commencement of the trial.
According to Section 23 of the Employment Ordinance, wages due upon expiry of the last day of the wage period must be paid as soon as practicable, but not later than seven days. Any employer failing to do so wilfully and without reasonable excuse is liable to a maximum fine of $200,000 and imprisonment for one year.

The owner of an optical shop has been fined $15,000 (US$1,900) at the Sha Tin Magistrates' Courts for wage offences under the Employment Ordinance. The prosecution was launched by the Labour Department. The employer failed to pay wages to an employee within seven days of the expiry of the wage period and the termination of employment. The amount of wages involved was about $29,800 (US$3,800).
According to the Employment Ordinance, wages due upon expiry of the last day of the wage period or upon termination of employment must be paid as soon as practicable, but not later than seven days. Any employer who fails to do so wilfully and without reasonable excuse is liable to a maximum fine of $200,000 and imprisonment for one year.
