The new Acas Code of Practice on disciplinary and grievance procedures comes into effect from 6 April 2009, replacing the former statutory procedures. The legislation makes provision for the handling of situations that straddle the effective date of the change and the Department for Business, Enterprise and Regulatory Reform (BERR) has published a two-page flowchart to help employers understand which cases should be handled under the old rules and which under the new.

The draft Acas Code of Practice on discipline and grievance procedures has received formal approval by Parliament and comes into effect on 6 April 2009. It is supported by a non-statutory guide on resolving discipline and grievance issues in the workplace.

In June 2008, the Government published a consultation document entitled Dispute Resolution – Secondary legislation consultation that sought views on a number of measures relating to the reforms to the dispute resolution procedures in the Employment Act 2008.

The Acas revised Code of Practice on discipline and grievance has been approved by the Secretary of State for Business, Enterprise and Regulatory Reform. Before the Code comes into effect on 6 April 2009 it requires Parliamentary approval and it remains a “draft” until that approval is obtained.

The Employment Bill, currently before Parliament, includes measures to repeal the statutory dispute resolution procedures and replace them with a new regime involving an Acas statutory code of practice on disciplinary and grievance procedures.

Wage-fixing machinery in the agricultural industry in Scotland has been in place in various forms since 1917. The Agricultural Wages (Scotland) Act 1949 consolidated the regulatory Acts of 1937 and 1940 and provided for the establishment of the Scottish Agricultural Wages Board (SAWB). Under the 1949 Act and its subsequent amendments, the Scottish Agricultural Wages Board is empowered to make Orders fixing minimum wage rates, holiday entitlement and other conditions of service for agricultural workers in Scotland.

At the beginning of May, Acas published a draft Code of Practice on discipline and grievance in employment. The code is being revised to take into account the changes being made to workplace dispute resolution procedures by the Employment Bill, currently before Parliament, in particular the removal of the statutory dismissal and discipline procedures.

One of the changes included in the Employment Bill that is currently before Parliament is the repeal of the statutory dispute resolution procedures, prompted by the Gibbons Review which found that the statutory procedures led to disputes becoming formalised and encouraged the involvement of lawyers at an earlier stage of the grievance. In their place, the Bill provides for the development by Acas of a new code of practice.
