Employers have been reminded that, under The Conditions of Employment (Guernsey) Law, 1985 as amended, all employees who are contracted to work 15 hours per week or more must be issued with a “ written statement” outlining the main terms and conditions of their employment, or a written contract, within four weeks of the commencement of employment.

On 20 January, Guernsey and the United Kingdom entered into a tax information exchange agreement (TIEA). There was also an agreement reached to revise the long-standing Double Taxation Agreement between the countries so that Guernsey residents will not have to pay UK tax on UK pensions that do not relate to government service Such pensions will only be taxed in Guernsey and will, as a result, pay tax at a lower rate.

From January 2009, employers are required to tax the provision of benefits-in-kind through the Employees’ Tax Instalment (ETI) Scheme. The Income Tax Office has updated the Benefits in Kind Guide and it is available to download from the link shown below. Relevant parts of the Guide have been updated to explain the implications of the new method of taxation.

In June 2008, the Treasury and Resources Department put forward proposals to change income tax law to require the taxation of benefits-in-kind through the Employees’ Tax Instalment (ETI) Scheme from 1 January 2009.  Benefits taxed in this way would also be liable for social security contributions.

The States Income Tax department has published a new version of An Employers Guide to the Employees’ Tax Instalment Scheme.  The ETI Scheme is Guernsey’s equivalent of the UK’s PAYE scheme for the collection of income tax in employment.

The revisions to the upper earnings limits in 2007 and 2008 and the 1% increase in the employers’ contribution rate in 2008, with compensatory reductions in the States grants, has produced an annual saving to general revenue of at least £26m per year.
