The government has responded quickly to a press campaign targeted at restaurants that allegedly fail to pass on tips in full to their staff. New legislation is promised that will prevent tips being counted towards the national minimum wage, starting with a consultation in the autumn.

This week we also review, in some detail, two recent documents. Firstly, we explain and illustrate the Regulations that will change entitlements to terms and conditions during maternity and adoption leave. Note that many employees now taking such entitlements may already be entitled to the new rights. Secondly, a Treasury consultation document discusses recently identified issues surrounding the use of “overarching” contracts by “umbrella” companies and employment agencies. In explaining and reviewing these perhaps unfamiliar terms, we have taken the opportunity of clarifying the various methods that have been used by personal and managed service companies to avoid tax and NICs liabilities and how the government has acted against them.
