Heyday Ruling Provides Clarification, Says IPP

The Institute of Payroll Professionals (IPP) believes the Heyday ruling has provided employers with much-need clarification to the law regarding the compulsory retirement age.
Last week the High Court ruled that it is legal for employers to retire employees at the age of 65. This long-awaited decision follows the challenge led by Age Concern and Help the Aged against the UK government’s default retirement age of 65.
Despite the ruling being criticised by some organisations, the IPP believes it is a positive outcome for employers and provides long awaited clarification for the payroll process.
Karen Thomson, Associate Director of Policy, Research and Strategic Visibility, says: “The IPP are pleased that the Heyday challenge has finally come to resolution with a positive outcome for employers. The ruling provides clarity for employers and this will save a huge amount of time and cost for employers who would have needed to amend all their HR and remuneration policies should the challenge brought have been upheld.
“For workers in payroll, it is vital that every area of employment law is clarified and the ruling appears to provide an assurity for employers where previously there was none.”
In response to the ruling, the IPP is urging employers, particularly in this economic climate, to review the skills of their employees. They believe that employers should consider requests from any person over the age of 65 years who has expressed an interest in working beyond the normal retirement age.
Karen Thomson continues: “When working in the payroll profession, in addition to possessing academic qualifications, experience is extremely valuable. The IPP would therefore encourage any employer who receives a request from an experienced payroll professional to work beyond the age of 65 years to grant the request.”
