hi all,
have done a few searches and looked over a few posts, there are a few articles that kind of outline my questions but nothing in black and white,,

i have been in my current job for just over 5 months,
in my first month i had approx 5 days off.
last pay day i had deductions due SSP been paid for the 5 days i had off in february. this left me in a rather tight situation these past few weeks as i was £140 short of what i was expecting.

work didnt even inform me that this transaction was going ahead.
i had no email, no letter and no phone call prior to this event.
my manager had a chat with HR payroll dept,
they apologised and announced that there is still another day to be deducted and they promised i would be informed via phone, writing or email when it would be.

my pay slip is due in a day or 2 and im half expecting to see this next deduction with out been told.

this is why im pre empting that situation to see where i stand legally.

normaly i wouldnt be to bothered as we all make mistakes but the past 4 months they have messed up my wages in one way or another, mainly not paying my over time correctly and always late.

from what i have read on the legal side, my company are supposed to notify me in writing when they are to make any deductions from my wages..

Hi,

Well technically you are right, deductions can only be made if they are statutory, contractual or by express permission from you.

In this case the company could claim that the deduction is contractual because your contract will clearly state that you will not be paid for absences and this is all they are doing.

I agree that it is better if you are clearly informed in advance that the deduction will actually take place, however, if you were off 5 days and they are going to reduce your pay by 5 days there is an argument which says you must have known it was going to take place.
