I am not an expert on US labor laws, but you will find California's provisions on handling non-payment of wages at http://www.dir.ca.gov/dlse/dlseWagesAndHours.html
There is a link on that page to help you to make a wages claim. I do not know, however, how wages claims are affected if the reason for non-payment is insolvency of the employer.
