Hi

can anyone tell me if holiday is accrued during a probationary period. I have a member of staff who started in March on a 3 month probation period. (holiday year started in April) This member of staff left 01/08/2008 and I am trying to calculate holiday acrued. Any help would be greatly appreciated!!

Welcome to the PayPerShop Forum and thank you for posting your question.

Yes, every worker is entitled to holiday pay on termination, so you will need to pay at least the statutory minimum due - for holiday years starting in April 2008, the annual minimum is 4.8 weeks, equivalent to 24 days for a 5-day worker. So, if the employee worked for three months, the entitlement on termination would be 6 days. If any paid holiday was taken during the probationary period, that should be deducted from the 6 days.

However, even for employees taken on for a probationary period, there should be a contractual holiday provision in place, even if it is the same as the statutory minimum. It could be more, so you need to check that too.

Just a point to note in this thread.

The 4.8 weeks (ie 24 days) holidays introduced from Oct 2007 is an interim increase in the minimum statutory holiday entitlement meant to capture the normal 8 public holidays (it goes up to 5.6 weeks ie 28 days in April 2009)

Many employers will pro-rata holidays on leaving or starting based only on the contractual basic entitlement - that is not including public hols in the holiday year. However, they must ensure that this pro-rata does not fall below the calculation based on the stautory annual minimum.

Having said that, I haven't come across a leaver's pro-rata holidays calculated on the contractual basic + public holidays. Unless anyone cares to say?
