I currently work for a recruitment agency as a class 1 hgv driver.
I was recentley diagnosed with cancer on my left Kidney and as a result i had my kidney removed on 9.11.07.
I applied for unemployment benifit and incapacity benifit all of wich i was told im not entiteld to, ( even though i pay nearly £200 pw in tax and national insurance.) as i work over 50 hours a week on the agency. I was told by social security that the laws changed and that the recruitment agency i work for have to pay me statutery sick pay. Today i was told by my agency that i work for that i will be paid £72 pw. Im sick as a pig about this,im supposed to be resting and recovering from a major operation and illness, yet im sat worrying how im going to live. Can the recruitment agency pay me so little ??????????????????????????? Sad

Thank you for posting your question. I'm afraid it is correct that the weekly rate of statutory sick pay is £72.55 at present and it is paid by an employer, the agency in your situation, for up to 28 weeks. Beyond that, if you are still off work, you can claim Incapacity Benefit.

There are other state provisions that might help you but the contributors on this forum are not usually experts on state benefits. I recommend that you look at the advice guide website run by the Citizens Advice Bureau, at http://www.adviceguide.org.uk/index/life/benefits.htm, and match the information provided to your circumstances.

You can also arrange to speak to an advisor at your local Citizens Advice Bureau. You may wish to explore other possible entitlements from the recruitment agency, such as holiday pay. Visit http://www.citizensadvice.org.uk/index/getadvice.htm.
