I can understand your desire not to employ a student who has signed a P38(S) form outside of holiday times but, in fact, it is not your problem. The form requires the student to declare that "I have no employment except during holidays", so you do not need to police the situation. As long as the employment is during the Easter break, the long summer and/or the Christmas break, you do not need to worry about the precise dates.
You should, however, be careful not to change the working hours of a student who has been working for you during the holidays to just evenings and weekends as that would suggest that they have returned to college or university.
